Article 3 – Applicability of the general terms and conditions
3.1 These general terms and conditions apply to every offer made by Matelier and to every distance contract concluded between Matelier and the consumer. 3.2 At the moment that you place an order via the webshop, by email or in any other way whatsoever, you indicate that you agree to the general terms and conditions. 3.3 The parties can only deviate from these terms if they have agreed to do so expressly and in writing. 3.4 The parties expressly exclude the applicability of additional and/or deviating general terms and conditions of the customer or of third parties.
Article 4 – Offers, prices and payment
4.1 All offers on madebymatelier.nl are non-binding, unless expressly stated otherwise. Offers do not automatically apply to repeat orders. 4.2 If an offer has a limited period of validity or is made subject to conditions, this is explicitly stated in the offer. 4.3 All prices that Matelier applies are in euros, are inclusive of VAT and exclusive of any other costs such as administration costs, levies and travel, shipping and transport costs, unless expressly stated otherwise or otherwise agreed. 4.4 All prices that Matelier applies for its products or services, on its website or that have otherwise been made known, may be changed by Matelier at any time. 4.5 An increase in the cost prices of products or parts thereof, which Matelier could not foresee at the time of making the offer or, as the case may be, the conclusion of the agreement, may give rise to a price increase. 4.6 You can pay for the products on the website via Mollie, including with iDEAL, PayPal or credit card. Once the payment has been received, production is set in motion and your order is processed.
Article 5 – Personal data
5.1 Your personal data is included in Matelier's customer database. Matelier does not provide data to third parties (other than those necessary for the performance of the agreement, e.g. PostNL, Mollie), as a result of which your privacy is not at stake. By accepting our terms you agree to the privacy statement. 5.2 Matelier uses the customer's personal data for the acceptance and performance of the distance sales contract and for customer relationship management. In doing so, Matelier observes the applicable laws and regulations in the field of privacy. 5.3 The data provided by the other party with any order or request is included in Matelier's customer database. This data is used solely to inform the other party as well as possible about existing and new activities of Matelier.
Article 6 – Shipping and delivery
6.1 The order is delivered to your home, unless you have indicated on the website that the order is to be delivered to a different delivery address. 6.2 We use PostNL for all shipments. The order is sent as soon as possible once the payment has been received. You will receive a shipping confirmation by email at the moment the order is shipped. 6.3 Delivery takes place while stocks last. Matelier will inform you when a product is no longer in stock. 6.4 If delivery is going to take longer than thirty days, Matelier will inform the customer of this in good time. In that case, the customer has the right to cancel their order free of charge. 6.5 We aim to send the order within 1-2 working days via PostNL. 6.6 The risk of damage and/or loss of products rests with the entrepreneur until the moment of delivery to the consumer or a third party designated in advance by the consumer, unless expressly agreed otherwise. 6.7 The risk of the products passes to the consumer at the moment of delivery to the consumer or a third party designated in advance by the consumer. 6.8 If you have provided an incorrect address for delivery yourself, the additional costs are at your expense.
Article 7 – Intellectual property rights
7.1 The (intellectual property) rights relating to the website, including the rights to the texts, images, design, data files, photos and other (still and/or moving) visual material, formats, software, trademarks (including domain names) and other materials, are vested in Matelier, its licensors, the manufacturers of the relevant products and/or third parties with whom Matelier is not affiliated. 7.2 You may not make (parts of) the website available to third parties and/or reproduce it in any way, other than by downloading and viewing it on a single computer and/or printing one hard copy. 7.3 In addition, you may not make any changes to the delivered products, unless the nature of what is delivered implies otherwise or it has been agreed otherwise in writing. 7.4 You may only place a hyperlink to the website if this is done for purely informational purposes.
Article 8 – Retention of title
8.1 Matelier remains the full owner of the delivered product until the moment that the purchase price has been paid in full. 8.2 Until that time, Matelier may invoke its retention of title and take back the goods. 8.3 Before ownership has passed to the customer, the customer may not pledge, sell, dispose of or otherwise encumber the products. 8.4 If Matelier invokes its retention of title, the agreement is deemed to be dissolved and Matelier has the right to claim damages, lost profit and interest.
Article 9 – Right of withdrawal
9.1 A consumer can cancel an online purchase without giving a reason during a cooling-off period of 14 days, provided that: – the product has not been used, – it is not a product that has been made to measure or adapted specially for the consumer, – it is not a product that cannot be returned for hygiene reasons, – it does not concern an (order for) urgent repair, – the consumer has not waived their right of withdrawal. 9.2 The cooling-off period of 14 days as referred to in article 9.1 begins on the day after the consumer, or a third party designated in advance by the consumer, has received the last product or part of 1 order. 9.3 The consumer can make known that they are invoking their right of withdrawal by sending an email to [email protected] in which they state at least: – the order number of the order to which the withdrawal applies, – the products and/or services for which they wish to use their right of withdrawal. 9.4 The consumer is obliged to return the product to Matelier within 14 days of making known their right of withdrawal, failing which their right of withdrawal will lapse. 9.5 The costs of returns are at all times borne by the consumer. The consumer ensures that there is valid proof of dispatch of the return shipment. The products must be returned in the original packaging and in proper condition. If the products have been used contrary to the conditions mentioned in article 9.1, or damaged, the right to cancel lapses. Subject to the provisions of the previous sentence, Matelier will ensure that, within 14 days of proper receipt of the return shipment, the purchase amount, including the original standard shipping costs, is refunded to the buyer. 9.6 From the moment the order has been delivered, the consumer bears responsibility for the products.
Article 10 – Miscellaneous
10.1 Any deviations from these general terms and conditions can only be agreed in writing. No rights can be derived from such deviations with regard to legal relationships entered into at a later date. 10.2 Matelier's records serve, subject to evidence to the contrary, as evidence of the requests and/or orders made by you. You acknowledge that electronic communication can serve as evidence. 10.3 Matelier is entitled to transfer the rights and obligations arising from the agreement with you to a third party by mere notification to you. 10.4 If and insofar as any provision of the general terms and conditions is declared void or is annulled, the remaining provisions of these general terms and conditions will remain in force unaffected. Matelier will then establish a new provision to replace the void/annulled provision, taking into account the purport of the void/annulled provision as far as possible.
Article 11 – Set-off
11.1 Unless the customer is a consumer, the customer waives their right to set off a debt owed to Matelier against a claim against Matelier.
Article 12 – Applicable law and competent court
12.1 Agreements between Matelier and the consumer to which these general terms and conditions relate are governed exclusively by Dutch law. Mandatory consumer protection in the country where you live continues to apply. 12.2 These general terms and conditions may be amended by Matelier at any time. Matelier therefore advises checking the general terms and conditions regularly.
Article 13 – Performance of the agreement and warranty
13.1 Matelier warrants that the products comply with the agreement, the specifications stated in the offer, the reasonable requirements of soundness and/or usability and the statutory provisions and/or government regulations existing on the date of the conclusion of the agreement. 13.2 Matelier does not warrant that the product is suitable for use other than normal use.
Article 14 – Complaints
14.1 Complaints submitted to Matelier are answered within a period of 14 days, counted from the date of receipt. If a complaint requires a foreseeably longer processing time, Matelier will respond within the period of 14 days with an acknowledgement of receipt and an indication of when the consumer can expect a more detailed answer.
If you have complaints or are dissatisfied about certain matters, do not hesitate to contact Matelier. You can send an email to [email protected]. We would be glad to hear your story. Of course, Matelier will do its best to resolve this satisfactorily.
